Statutory Rape Defined
Statutory rape is defined as unlawful sexual intercourse with a minor, a person who is under the age of 18. Although a victim in this case may have consented to or even initiated sexual activity, they are considered to be under the age of consent. They may therefore not actually give consent to sexual intercourse, leaving the older participant at risk of facing criminal statutory rape charges. Depending on the age of the alleged offender and the victim, a defendant may face varying penalties. It may actually be charged as a misdemeanor or a felony under California Penal Code. Following are basic descriptions of statutory rape:
- If the defendant is less than three years older than the alleged victim, statutory rape may be a misdemeanor offense, punishable by informal probation, up to one year in county jail and a fine of up to $1,000.
- If the defendant is more than three years older than the alleged victim, statutory rape may be charged as a misdemeanor or felony punishable by up to one year in county jail and/or a fine of up to $1,000 or by imprisonment in state prison.
- If the defendant is 21 years old or older and the alleged victim is under 16, statutory rape may be charged as a misdemeanor or felony punishably by up to one year in county jail and/or a fine of up to $1,000 or by imprisonment in state prison for two, three or four years.
